SMU EVENT REgistration Terms and conditions
By registering for this event, I acknowledge and agree to the following:
1. Event Organizer
This event is organized and administered by Medium Rare Mgmt, LLC ("Organizer") and is being held at Southern Methodist University ("University"). The Organizer is responsible for event registration, communications, and event operations. The University provides the venue and/or institutional support but is not responsible for the administration of the event unless expressly stated. This registration and ticket giveaway and or the event may be canceled or postponed by Organizer, at any time in its sole discretion.
2. Registration and Admission
Registration is subject to availability and does not guarantee admission if capacity limits are reached. The event has limited capacity, and entry shall be granted on a first come, first served basis. A ticket does not guarantee admission. Travel is not included in the giveaway, ticketholders are responsible for their own transportation to and from the event, accommodations and any/all other costs and expenses associated with attending the event.
The Organizer reserves the right to modify the event schedule, speakers, venue, or format without prior notice.
The Organizer and the University reserve the right to deny or revoke admission for safety, security, policy, or operational reasons.
All registrants must be a student at the University (i.e., must sign up with an email address ending in .edu) and may go to the web page (the “Site”), and complete the registration form. Each registration must include the registrant’s: (i) full name; (ii) e-mail address; and (iii) acknowledgement registrant is eighteen (18) years of age or older; and (iv) any other information requested on the form (collectively, “Site Registration Data”). The giveaway is open only to individuals that are citizens or lawful permanent residents of, and living in, the continental United States and the District of Columbia, who are eighteen (18) years of age or older and that can enter into legally binding contracts under applicable law.
3. Compliance with University Policies
All attendees must comply with applicable Organizer and University policies, campus regulations, and facility requirements while on University property.
Students attending the event remain subject to all applicable University student conduct codes and disciplinary procedures.
Attendees must follow the instructions of University officials, campus security personnel, event staff, and the Organizer's representatives.
4. Code of Conduct
Attendees are expected to conduct themselves in a respectful and professional manner toward speakers, guests, students, faculty, staff, and other participants.
Harassment, discrimination, intimidation, disruptive behavior, or conduct that jeopardizes the safety or enjoyment of others will not be tolerated.
The Organizer and University reserve the right to remove any attendee whose behavior violates these standards without refund or compensation.
5. Guest Speakers and Presentations
Views and opinions expressed by speakers, presenters, sponsors, exhibitors, or guests are their own and do not necessarily reflect those of the Organizer, Credit One Bank, N.A., or the University.
The Organizer reserves the right to moderate audience participation, including questions, comments, and discussions.
6. Photography, Video Recording, and Media Release
The event may be photographed, recorded, livestreamed, or otherwise documented by the Organizer, University, media representatives, or authorized third parties.
By attending, attendees grant the Organizer, media representatives, or authorized parties permission to use their name, image, likeness, voice, and appearance in photographs, videos, recordings, broadcasts, promotional materials, educational materials, and future marketing communications without compensation.
Attendees may not record, photograph, livestream, or distribute event content for commercial purposes without prior written permission from the Organizer.
7. Privacy and Data Collection
Registration information will be collected and processed by the Organizer for purposes including event administration, attendee communications, security, logistics, and post-event follow-up.
Registration information may be shared with the University as necessary for venue management, security, compliance, and event administration.
Personal information will be handled in accordance with applicable privacy laws and the privacy policies of the Organizer and, where applicable, the University.
8. Health, Safety, and Security
Attendees must comply with all applicable health, safety, access, and security requirements established by the Organizer and the University.
Prohibited items, restricted areas, and security procedures are subject to change at the discretion of the Organizer and University.
Failure to comply may result in removal from the event.
9. Cancellation, Postponement, and Changes
The Organizer reserves the right to cancel, postpone, reschedule, relocate, or otherwise modify the event at any time.
In the event of a material change, registered attendees will be notified using the contact information provided during registration.
10. Assumption of Risk and Liability
Attendance and participation are voluntary.
Attendees assume responsibility for their personal belongings and conduct while attending the event.
To the fullest extent permitted by law, attendees release and hold harmless the Organizer, the University, their respective officers, employees, agents, contractors, sponsors, and representatives from claims arising from participation in the event, except where caused by gross negligence or willful misconduct.
11. Communications
By registering, attendees consent to receiving communications relating to the event, including confirmations, reminders, event updates, logistical information, and post-event surveys.
Attendees may opt out of non-essential promotional communications where permitted by law.
By registering, and where you have otherwise provided the requisite consent, you agree to receive telemarketing (including text message marketing where you have provided your “prior express consent” as required under the Telephone Consumer Protection Act (“TCPA”)), e-mail and direct mail marketing messages from Organizer and its marketing partners (where applicable), subject to the Organizer Privacy Policy. 12. Acceptance of Terms
By completing registration and/or attending the event, I acknowledge that I have read, understood, and agree to these Terms and Conditions.
13. RELEASE:
By registering, you agree to release and hold harmless Medium Rare Mgmt, LLC, Credit One Bank, N.A., University, and their respective representatives, affiliates, subsidiaries, parents, agents, contractors, sub-contractors and their respective members, officers, directors, employees and agents (collectively, “Covered Parties”) from and against any and all liability for any injuries, loss or damage of any kind arising from, or in connection with, the ticket giveaway and the event (including each ticket, and all travel associated with attending the event, as applicable) including, but not limited to, liability arising from copyright infringement, improper use of likeness, personal injury, death, damages or monetary loss.
Restrictions, conditions and limitations apply. By entering, each registrant further agrees that, in the event that there is any conflict or other inconsistency between these Terms and Conditions and any advertisements, promotional or marketing materials, e-mails or announcements relevant to the giveaway, these Terms and Conditions will govern.
14. CHOICE OF LAW/DISPUTE RESOLUTION/CLASS ACTION:
These Event Registration Terms and Conditions shall be treated as though they were executed and performed in New York, New York and shall be governed by and construed in accordance with the laws of the State of New York (without regard to conflict of law principles). The parties (and Covered Parties) hereby agree to arbitrate all claims that may arise under and/or relate to the Event Registration Terms and Conditions and/or the event. Without limiting the foregoing, should a dispute arise between the parties/any Covered Parties including, without limitation, any matter concerning the event, Event Registration Terms and Conditions or the breach of same by any party hereto: (a) the parties/Covered Parties agree to submit their dispute for resolution by arbitration before the American Arbitration Association (“AAA”) in New York, NY, in accordance with the then current Commercial Arbitration rules of the AAA; and (b) you agree to first commence a formal dispute proceeding by completing and submitting an Initial Dispute Notice which can be found on the website. The Covered Party(ies) named in your Initial Dispute Notice (collectively, the “Named Parties”) may choose to provide you with a final written settlement offer after receiving your Initial Dispute Notice (“Final Settlement Offer”). If the applicable Named Party(ies) provide(s) you with a Final Settlement Offer and you do not accept it, or such Named Party(ies) cannot otherwise satisfactorily resolve your dispute and you wish to proceed, you must submit your dispute for resolution by arbitration before the AAA, in your county of residence, by filing a separate Demand for Arbitration, which is available here. For claims of Ten Thousand Dollars ($10,000.00) or less, you can choose whether the arbitration proceeds in person, by telephone or based only on submissions. If the arbitrator awards you relief that is greater than the applicable Final Settlement Offer, then the Named Party(ies) will pay all filing, administration and arbitrator fees associated with the arbitration and, if you retained an attorney to represent you in connection with the arbitration, the Named Party(ies) will reimburse any reasonable attorneys' fees that your attorney accrued for investigating, preparing and pursuing the claim in arbitration. Any award rendered shall be final and conclusive to the parties and a judgment thereon may be entered in any court of competent jurisdiction.
To the extent permitted by law, you agree that you will not bring, join or participate in any class action lawsuit as to any claim, dispute or controversy that you may have against any of the Covered Parties. You agree to the entry of injunctive relief to stop such a lawsuit or to remove you as a participant in the suit. You agree to pay the attorney's fees and court costs that any Covered Party incurs in seeking such relief. This provision prevents you from bringing, joining or participating in class action lawsuits: (i) does not constitute a waiver of any of your rights or remedies to pursue a claim individually and not as a class action in binding arbitration as provided above; and (ii) is an independent agreement. You may opt-out of these dispute resolution provisions by providing written notice of your decision within thirty (30) days of the date that you first enter the Giveaway.
15. DISQUALIFICATION:
The Covered Parties are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or technical failure, lost registration, jumbled, or misdirected transmissions, or other error of any kind, whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of the giveaway, as solely determined by Organizer, will be disqualified. If disqualified for any of the above reasons, Organizer reserves the right to terminate registrant’s eligibility to attend the event. In the event that any portion of the giveaway is compromised by technical error, virus, bugs, non-authorized human intervention or other causes beyond the control of Organizer which, in the sole opinion of Organizer, corrupts or impairs the administration, security, fairness or proper determination of the Giveaway, Organizer reserves the right, in its sole discretion, to suspend or terminate the giveaway or any part of the giveaway, or any combination of the above. The Covered Parties are not responsible for any problem with registrations generated by computer hardware or software malfunction, error or failure, whatever the cause.
16. INDEMNIFICATION:
You agree to release, indemnify and hold the Covered Parties harmless from and against any and all claims, expenses (including reasonable attorneys' fees, costs and settlement costs), damages, suits, costs, demands and/or judgments whatsoever, made by any third party due to or arising out of: (a) your improper and/or unauthorized participation in the Giveaway; (b) your breach of these Terms and Conditions; and/or (c) your violation of any rights of another individual and/or entity. The provisions of this paragraph are for the benefit of the Covered Parties. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf.
17. LEGAL WARNING:
Any attempt by any individual, whether or not registrant, to damage, destroy, tamper with or vandalize the Site and/or associated technology, or otherwise interfere with the operation of the giveaway, is a violation of criminal and civil law and Organizer will diligently pursue any and all remedies in this regard against any offending individual or entity to the fullest extent permissible by law and in equity.
